1. General Terms
1.1. These Terms and Conditions govern the use of the Service located at https://boss.az/ by its Users.
1.2. For the purposes of these Terms and Conditions, the following definitions apply:
1.2.1. Service
The internet resource (website) located at https://boss.az/, including mobile applications for various operating systems, related services, software, graphical interface and design, databases, any sections or subsections of the Service, as well as all information posted by the Administration or Users.
1.2.2. Administration
The Service is administered by DIGITAL CLASSIFIEDS LLC (TIN: 1405631661), incorporated and registered under the laws of the Republic of Azerbaijan. All proprietary and intellectual property rights to the Service belong exclusively to the Company.
1.2.3. User
Any legally capable individual or legal entity that has accepted these Terms and Conditions and uses the Service.
1.2.4. Employer
A User who posts job vacancy listings on the Service and searches for employees or candidates.
1.2.5. Job Seeker
A User who posts their CV/resume on the Service and/or applies for vacancies.
1.2.6. Personal Account
A personal account area accessible to the User after registration on the Service and managed independently by that User. Each User may have only one Personal Account.
1.2.7. Listing
A vacancy listing posted by an Employer or a resume/application submitted by a Job Seeker.
1.2.8. User’s Personal Information
A collection of information relating to the User, including personal data voluntarily provided during registration, as well as technical information automatically transmitted during use of the Service (IP address, browser data, cookies, etc.).
1.2.9. Spam
Mass, unsolicited, or unwanted advertising, informational, promotional, or other communications sent without the recipient’s consent.
1.2.10. Parties to these Terms and Conditions
The Administration and the User.
1.3. Any terms not expressly defined in these Terms and Conditions shall be interpreted according to the meaning arising from the context of the Agreement. In the event of disagreement regarding interpretation, the interpretation established by the Administration shall prevail.
1.4. Use of the Service is governed by applicable legislation and these Terms and Conditions.
1.5. These Terms and Conditions constitute a public offer.
1.6. By using the Service, the User confirms acceptance of these Terms and Conditions in full.
1.7. Where the Service is used on behalf of a company or organisation, that entity is deemed to have accepted these Terms and Conditions.
1.8. The Administration reserves the right to amend these Terms and Conditions unilaterally at any time.
1.9. In the event of material amendments, the Administration shall notify Users through notices on the Service and/or via the email address provided during registration.
1.10. Amendments enter into force from the moment they are published on the Service.
1.11. If the User disagrees with the updated Terms and Conditions, they must discontinue use of the Service.
1.12. The Administration provides Users with the ability to post vacancies, create resumes, search for employment, and use related services.
1.13. Certain services may be governed by additional rules and/or separate agreements.
1.14. The User acknowledges that the Service may contain advertising materials. The Administration bears no responsibility for such advertising content.
2. Registration and Account Security
2.1. Registration on the Service is voluntary.
2.2. Registered Users receive access to additional functions and services.
2.3. The Administration may request verification of registration information at any time.
2.4. The User undertakes to keep their password confidential.
2.5. The User bears full responsibility for all actions performed using their account credentials.
2.6. The User may use the Service exclusively through their own Personal Account.
2.7. Use of another User’s registration credentials is prohibited.
2.8. If unauthorised access to the Personal Account is suspected, the User must immediately change their password and notify the Administration.
2.9. The Administration may use technical means to verify the accuracy of User information but does not guarantee its absolute accuracy.
3. Posting Listings
3.1. Registered and unregistered Users may post listings on the Service after completing the relevant form.
3.2. Employers must post only genuine and current vacancies.
3.3. Posting false, misleading, or fraudulent vacancies is strictly prohibited.
3.4. All agreements between Users are concluded directly between such Users.
3.5. The Service is not a party to relationships or transactions between Users and bears no responsibility for them.
3.6. The User agrees not to:

violate applicable legislation, international law, or accepted moral standards;

interfere with the normal operation of the Service;
-
infringe intellectual property or copyright belonging to third parties.
3.7. User comments and publications must comply with applicable law and accepted standards of ethics.
3.8. The Administration bears no responsibility for the content of listings, including external links.
3.9. The User grants the Administration a perpetual, irrevocable, worldwide, and non-exclusive right to use materials posted on the Service for the purposes of operating and promoting the Service.
3.10. The User retains intellectual property rights to their materials.
3.11. The User undertakes to provide complete, accurate, and truthful information.
3.12. The User must promptly correct inaccurate or incomplete information.
3.13. By posting a listing, the User confirms that they:

are legally entitled to carry out the activity described;

possess all required licences, permissions, and rights;
-
have the right to use third-party materials and assets.
3.14. The Administration may request additional documents and information from the User.
3.15. Publication of a listing may be suspended until such information is provided.
3.16. The following are prohibited on the Service:

links to competing websites or marketplaces;
-
direct links to external websites;
-
content violating applicable law or third-party rights;
-
fraudulent or non-existent vacancy listings.
3.17. User data and actions must not:
-
contain false or misleading information;
-
facilitate fraud or deception;
-
violate privacy or proprietary rights;
-
damage honour, dignity, or business reputation;
-
contain threats, slander, or hate speech;
-
promote criminal, terrorist, or extremist activity;
-
contain obscene or pornographic content;
-
include viruses or malicious software;
-
contain unauthorised advertising materials.
3.18. The Administration may, without prior notice, edit, suspend, block, or delete listings that violate these Terms and Conditions.
3.19. Payment for paid services does not guarantee preservation of a listing where the Terms and Conditions are violated.
3.20. Payments for services are non-refundable in the event of rule violations.
3.21. The User bears full responsibility for the content of posted listings.
4. Paid Services
4.1. Users may order the following paid services:

Paid Listing
4.2. Prices for services are displayed on the relevant pages of the Service.
4.3. Accepted payment methods include:

bank cards;
-
online payment systems;
-
other payment methods accepted by the Administration.
4.4. Users may submit refund requests to the Administration.
4.5. Refund decisions are made solely at the Administration’s discretion.
4.6. Refunds may be denied in the following cases:
-
repeated violations of these Terms and Conditions;
-
activation of the purchased service;
-
technical failures involving payment systems;
-
other reasonable grounds determined by the Administration.
5. Personal Data Protection
5.1. The Administration processes personal data in accordance with the legislation of the Republic of Azerbaijan.
5.2. Detailed information is provided in the Privacy Policy.
5.3. By using the Service, the User consents to the processing of personal data.
5.4. The Administration may collect the following information:

surname, first name, patronymic;

email address;
-
phone number;
-
resume and employment history data;
-
IP address, browser data, and cookies.
5.5. Personal data may be transferred to third parties only:

with the User’s consent;
-
where required by law;
-
to trusted technical service providers.
5.6. The User has the right to:

access their personal data;

correct inaccurate data;
-
request deletion of data;

withdraw consent to processing.
6. Cookies
6.1. The Service uses cookies to improve user experience.

7.2. Such notifications may contain service, advertising, or informational content.
7.3. Messages are deemed delivered from the moment they are sent or published.
7.4. The Administration bears no responsibility for messages sent by other Users or automated systems.
7.5. Users may opt out of promotional communications.
7.6. Opting out of essential service notifications may not be possible.
8. Software
8.1. All rights to the Service, domain name, mobile applications, and software belong to the Administration.
8.2. The User is granted a personal, royalty-free, non-exclusive licence to use the Service.
8.3. Without written permission from the Administration, the following are prohibited:

copying or distributing software;

modifying software;
-
renting or leasing software;
-
attempting to obtain source code;
-
using automated access systems or bots.
9. Limitation of Liability
9.1. The Service is solely a platform for job vacancy listings.
9.2. The Service does not guarantee the accuracy of listings or the good faith of Users.
9.3. The Administration bears no responsibility for:
-
listing content;
-
relationships or transactions between Users;
-
technical failures or interruptions;
-
actions of third parties;
-
external websites or resources;
-
use of Users’ contact details by third parties.
9.4. The total liability of the Service is limited to the amount paid by the User for the Service.
9.5. The User uses the Service at their own risk.
10. Term and Termination
10.1. These Terms and Conditions enter into force from the moment the User begins using the Service.
10.2. The Agreement remains valid indefinitely.
10.3. The User may discontinue use of the Service at any time.
10.4. The Administration may suspend or terminate a User’s access to the Service at its discretion.
11. Miscellaneous
11.1. All disputes shall first be resolved through negotiations.
11.2. The laws of the Republic of Azerbaijan shall apply to these Terms and Conditions.
11.3. If any provision is held invalid or unenforceable, the remaining provisions remain in force.
11.4. These Terms and Conditions do not create any agency, employment, partnership, or joint venture relationship between the Parties.
